Unclaimed Property From Bankruptcy

How Am I Entitled To Funds From My Bankruptcy Case?

Your assets were sold for more than the amount of the debt you owed for chapter 7 cases. You paid more than the debt you owed for chapter 13 cases. The overage amount is the unclaimed property.

Why Didn't My Attorney Tell Me Anything?

Bankruptcy cases can take years to get through. Once the final asset is sold or the final payment is made, attorneys collect their fee and move on. They either willingly don't tell their clients of the unclaimed property or they themselves don't know about it. What Happens After I Sign?

Once you are a client, our legal team will be requesting the necessary documents for your claim through your recovery specialist. 

How Will I Be Informed?

Your recovery specialist will provide you with monthly emails to keep you informed about your recovery status. You may call, text, or email at any time to request an update.

How Long Will This Process Take?

Every case will differ in duration. Some cases may only take 3 months, while others may last up to a year. Factors that effect durations are liens, heirs who don't agree leading the case to go to probate, and dishonesty.

What If I Have Liens?

All lien holders will be paid before you to settle the debt. Our estimates take into account all the lien holders getting paid.

Do I Have To Pay Taxes On These Funds?

It is always best to ask a tax consultant for tax advice. These funds would not be considered as income, therefore taxes do not have to be paid.


Predatory Awareness

How Do I Know If I Am Being Taken Advantage Of?

Here is a list of signs of predatory activity.


  • The estimated proceeds are off by $40,000 or more.: Companies (and their lawyers) will promise to recover the estimate they gave you and keep the remaining. Ask them how they got their estimate and do your own research (like reading this FAQ page).



  • You are offered money up front.: This is the easiest one people fall for because they are being taken advantaged of in a time of need. They will make you sign for a lesser amount, then it's too late.

  • They don't tell you what their fee includes.: Companies will offer you a really good fee and not tell you of their other fees. This is the most common way people are being taken advantage of. Always ask what their fee includes and if there are others.



  • They trap you.: Companies know what they are doing is wrong so they will make it impossible for you to get out from under them. Always read before you sign. Check for paragraphs titled "exclusivity" and "cancellation" or anything similar.

  • They are charging more than 30%.: Even 30% is high for most cases. There is no need to charge this much as it takes away from the public service. We and our team want to get paid, but not from the lost of our clients.


How Do I Know If the Person Calling Me Is A Scam?

Anyone who asks for your card information is a scam. There is no need to ask for that because the goal is to get you paid, not the other way around. We don't need you to pay us when we are trying to get you paid.
