Frequently Asked Questions

Before the Sale

How can I stop my home from going to sale?

Here are links that reference to how someone can reverse a sale.

General (All States) - https://www.nolo.com/legal-encyclopedia/last-minute-strategies-stop-foreclosure.html

Texas - https://www.nolo.com/legal-encyclopedia/texas-foreclosure-laws-procedures.html

Can We Help Reverse the Sale?

As an Asset Recovery company, we do not offer the legal service of providing representation to reverse the sale of homes. We will be more than happy to refer you to attorneys who do so.

Who Should I Talk to About Reversing the Sale?

Situations like these should always be handled by an attorney experienced in real estate and foreclosure laws in your state.

After the Sale

Why Am I Receiving So Many Calls About Money In My Situation?

You are receiving calls because it is believed that the sale resulted with excess proceeds (aka surplus funds). These "companies" are trying to get your attention about it.

What are Excess Proceeds/Surplus Funds?

Excess proceeds or surplus funds are left overs from a bid placed at the auction. The loan provider can only receive what is owed to them. If the bid is over that amount, then you are entitled to the "left overs", which is essentially the equity of the property.

Why Did I Receive A Call From You?

We monitor foreclosures with the intent of helping parties to claim excess proceeds/surplus funds. We and our attorney enjoy providing our legal services to those who really need it. We have partnered with our law firm to provide this service to the public at a rate much lower than the standard being charged today by other law firms.

I Received A Call/Message From You, Now What?

Give us a call back at a time that best suits you. Expect a friendly human voice ready to answer any questions you may have and explain the next steps to get your funds recovered. You may text or email us back as well. We understand that not everyone's situation is the same and some may be more difficult than others, so we are available 24/7 for any inquires about recovering your funds.

How Much Is This Going To Cost?

You will pay $0 out of pocket for our services. We charge our standard fee and we work on the basis of contingency. That means our fee applies only when the job is completed. We do not back charge our clients or have hidden fees.

The Next Steps

I Want to Recover My Proceeds. What's Next?

Feel free to give us a call at a time most convivence for you or set an appointment here. Once we have established the attorney-client relationship and fee agreement, we will be able to begin the process of recovery.

What Happens After I Sign?

Once you are a client, our legal team will be requesting the necessary documents for your claim through your recovery specialist. Documents include ID and any other documents that may be needed to prove your entitlement and identification like death certificates, birth certificates, affidavits, the last 4 of your SSN, etc.

How Will I Be Informed?

Your recovery specialist will provide you with monthly emails to keep you informed about your recovery status. You may call, text, or email at any time to request an update.

How Long Will This Process Take?

Every case will differ in duration. Some cases may only take 3 months, while others may last up to a year. Factors that effect durations are liens, missing family history or documents, disagreeing heirs, probate, busy legal systems, and dishonesty.

What If I Have Liens?

Not every lien holder is entitled to claim your proceeds. If the lien holder did not attach the lien to your property (you would have received a notice from the court), then they are not entitled.

Entities who have higher entitlement are:

  • The foreclosing party (post-judgement fees)
  • Any past unpaid mortgages from previous homes
  • Any federal or state government entity (i.e.: HOA, HUD, IRS, state taxes, banks, etc.)
  • Any lien holder that has attached their lien to your property in a court proceeding

Do I Have To Pay Taxes On These Funds?

It is always best to ask a tax consultant for tax advice. These funds would not be considered as income, therefore taxes do not have to be paid.

Predatory Awareness

How Do I Know If I Am Being Taken Advantage Of?

Here is a list of signs of predatory activity.

  • The estimated of the excess proceeds are off: Companies (and their lawyers) will promise to recover the estimate they gave you and keep the remaining. Ask them how they got their estimate and do your own research (like reading this FAQ page).

  • You are offered money up front.: This is the easiest one people fall for because they are being incentivized with money in a time of need. Once you sign and accept the money, it's too late to back out.

  • They don't tell you what their fee includes.: Companies will offer you a really good fee and not tell you of their other fees. This is the most common way people are being taken from. Always ask what their fee includes and if there are others.

  • They trap you.: Companies (and their lawyers) will make it impossible for you to get out from under them once you sign with them. Always read before you sign. Check for sections titled "exclusivity", "cancellation", "termination" or anything similar.

  • They are charging more than 30%.: Even 30% is high for most cases. There is no need to charge this much as it takes away from the public service in our opinion. We and our team want to get paid, but not from the unnecessary lost of our clients.

How Do I Know If the Person Calling Me Is A Scam?

Anyone who asks for your card or bank information is a scam. There is no need to ask for that because the goal is to get you paid, not the other way around. We don't need you to pay us when we are trying to get you paid.
